Welcome to Social Krave Media Tech Pvt Ltd (“Company”, “we”, “our”, or “us”). These Terms & Conditions govern your use of our website (www.socialkrave.com) and all services offered by Social Krave. By accessing our site or engaging with our services, you (“Client”, “you”, or “your”) agree to comply with and be bound by these Terms.

1. Definitions

  • “Services” refers to all offerings from Social Krave, including but not limited to AI-Powered Marketing, Website Development, Application Development, Business Consulting, Digital Events, Branding & Offline Solutions, E-Commerce Solutions, Cloud Services, Photography & Videography, Event Management, Print Media, and Podcast services.
  • “Client” means the individual or organization engaging our services.
  • “Agreement” means these Terms along with any proposal, contract, or statement of work signed between us and the Client.

2. Acceptance of Terms

By using our website or services, you confirm that:

  • You have read and understood these Terms.
  • You are legally authorized to enter into this agreement.
  • You will comply with all applicable laws and regulations.

3. Services We Provide & Limitations

We strive to deliver high-quality professional solutions. However, you acknowledge and agree that:

  • We do not guarantee specific results, revenue, leads, or return on investment (ROI) from marketing campaigns.
  • We are not responsible for downtime, policy changes, or technical issues arising from third-party platforms (e.g., Google Ads, Facebook, Instagram, YouTube, app stores, hosting providers, etc.).
  • We are not liable for delays caused by the Client, such as delayed feedback, approvals, or missing information.
  • We do not provide services outside the scope agreed upon in the signed proposal or contract.
  • Clients may request changes to the scope or deliverables in writing, and Social Krave will provide revised timelines, costs, and approval steps before proceeding.

4. Payment Terms

  • Payment terms and schedules will be clearly outlined in the proposal, contract, or invoice agreed between Social Krave and the Client prior to the start of any project or service.
  • Services will commence only after the agreed initial payment is received.
  • For ongoing or retainer-based services, payments must be made on the dates specified in the signed agreement to ensure uninterrupted delivery.
  • While we do not impose penalties for late payments at present, consistent delays may impact service timelines. We value a professional and transparent relationship with our clients and expect the same in return.

5. Refund Policy

  • While payments are generally non-refundable, exceptional cases or ongoing/retainer services may be eligible for pro-rata credits or refunds upon mutual agreement with the client.

6. Ownership of Work

  • All deliverables, creative content, designs, or materials remain the property of Social Krave Media Tech Pvt Ltd until full payment has been received.
  • Once payment is complete, ownership rights are transferred to the Client, unless otherwise agreed in writing.

7. Privacy & Data Protection

  • We may collect and store client information strictly for business purposes and may share it with trusted third-party service providers only as needed to deliver the agreed services. Clients will be informed promptly in case of any data breaches.
  • Client data is treated as confidential and is never sold or shared with third parties without consent.
  • We take reasonable measures to safeguard data, but we are not responsible for breaches caused by circumstances beyond our control (e.g., cyberattacks, force majeure).
  • By using our services, you consent to our data practices as outlined in our Privacy Policy.
  • Social Krave follows applicable data protection regulations and will cooperate with clients to meet requirements such as GDPR or CCPA where relevant.

8. Use of Website & Content

  • All content on our website (text, logos, graphics, images, videos, software, etc.) is owned by Social Krave or its licensors.
  • You may use the content for personal, non-commercial purposes only.
  • You must not copy, modify, distribute, or reproduce any content without our prior written approval.

9. Termination of Services

  • Either party may terminate an ongoing project or monthly service with a 30-day written notice.
  • In case of termination, payments already made will not be refunded, and the Client remains liable for any outstanding dues.

10. Dispute Resolution

  • In case of any disagreement, both parties agree to attempt to resolve the issue through good-faith negotiation.
  • If unresolved, disputes will be referred to arbitration/mediation in Gurugram, Haryana, India, under applicable laws.
  • The decision of the arbitrator/mediator shall be final and binding.

11. Limitation of Liability

  • To the maximum extent permitted by law, Social Krave is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruptions, or data loss.
  • Our total liability under any contract shall not exceed the amount paid by the Client for the specific service giving rise to the claim.

12. Changes to Terms

  • We may update these Terms at any time without prior notice. The latest version will always be available on our website. Continued use of our services after changes are posted means you accept the updated Terms.

13. Governing Law

  • These Terms are governed by and construed in accordance with the laws of Gurugram, Haryana, India. Courts in Gurugram shall have exclusive jurisdiction over any disputes.
